Concept
Mediation is a form of out-of-court dispute resolution in which a third-party mediator (or mediators if more than one) is responsible for bringing the parties together so that they can negotiate directly towards a desired solution to their disagreement.
A Mediação mantém o poder decisório com as próprias partes conflitantes.
Mediation maintains the decision-making power in the hands of the conflicting parties themselves.
It is an effective resource for resolving disputes arising from situations involving various types of interests. Mediation is a confidential and voluntary process in which the responsibility for crafting decisions lies with the involved parties. Unlike arbitration and State Jurisdiction, in which the decision will be up to a third party.
The technical resources of mediation are also used as a preventive strategy, fostering environments conducive to mutual collaboration with the aim of avoiding the breakdown of relationships between the parties.
